Missouri ID scanning laws

Missouri allows venues to use ID scanning and gives ordinary bars and restaurants broad flexibility over scan records.

For bars, restaurants, dispensaries and retailers, the practical questions are when identification is required, which credentials matter, how electronic verification fits alongside the visual check and when customer-record rules change for dispensaries.

What Missouri venues should know

Do you have to check IDs in Missouri, and when?

The answer depends on the product and transaction.

Alcohol

Missouri does not require every alcohol customer to be carded. If staff ask for identification and the customer presents it, the alcohol law requires the credential to be compared with the person.

Keg sales are more specific. The retailer must require valid identification and complete the state identification record for the purchaser.

Tobacco and vape

Missouri's statute uses an appearance-based trigger tied to age 18, while federal law separately sets the nationwide tobacco sales age at 21. Retailers should therefore treat the state and federal requirements as separate layers.

Cannabis and hemp

Dispensaries require valid, unexpired government-issued photo ID at every sale and verify adult-use customers are at least 21. Missouri's 2026 cannabinoid legislation also changes where covered hemp-derived products may be sold beginning November 12, 2026.

Which IDs provide protection in Missouri?

Missouri's alcohol protections use more than one credential standard, so the context matters.

The credential-compliance provision lists valid, unexpired:

  • Driver's licenses from Missouri or another US state or territory
  • Missouri or other US state or territory nondriver IDs
  • US uniformed service identification
  • Passports

The criminal defense is broader and can include another official or apparently official photo document showing an age of 21 or older. Tobacco uses its own proof-of-age standard.

Can you keep data from an ID scan in Missouri?

Yes. Missouri does not set a general scan-specific field limit or retention period for ordinary bars, restaurants and stores.

Keg-sale forms are an exception because the alcohol rules require them to be kept for at least three months.

Dispensaries face a new rule beginning November 12, 2026. A dispensary may create or keep a record containing a consumer's identifying information only with the consumer's written agreement, and it may not refuse service simply because the consumer declines to have that record created or kept. Required medical-patient and caregiver records are treated separately.

What other Missouri laws reach the data you keep?

Stored driver's license numbers can bring Missouri's breach-notification law into play.

A customer's name combined with an unencrypted, unredacted driver's license number is personal information under Missouri's breach law. Depending on the incident, affected residents and other recipients may need to be notified.

Missouri does not currently have a comprehensive consumer privacy law or a general biometric privacy statute. Admission and exclusion decisions are separately subject to the Missouri Human Rights Act.

Does scanning give you a defense if you serve a minor in Missouri?

A scan can strengthen the record of the check, but Missouri's legal protections depend on the underlying ID review and good-faith requirements.

In licensing and related proceedings, full compliance includes comparing the photograph and physical characteristics on the credential with the customer. Missouri also provides a criminal defense based on reasonable cause to believe the customer was at least 21 and on the document the customer exhibited.

In civil claims, evidence that staff demanded and were shown a genuine-looking qualifying ID can also matter. A scan record can document which credential was presented and when, but it does not replace the visual comparison Missouri requires.

Can a customer refuse an ID scan in Missouri?

Missouri does not create a general right to refuse a scan at ordinary bars, restaurants or stores, and it does not require a manual alternative.

Venue policy therefore controls much of the ordinary workflow, subject to other applicable laws. The important exception begins November 12, 2026 for dispensaries that choose to keep covered consumer identifying records: they may not refuse service solely because a customer declines to have that record created or kept.

Missouri casino law has its own separate rules for patrons entering a gambling area.

Alcohol, tobacco and cannabis

Alcohol

Electronic verification can support Missouri's alcohol check, but staff still need to compare the ID with the customer.

The licensee's protection from penalties depends on compliance with the credential rule and good faith. A scan can help verify and document the credential, while the required visual comparison remains part of the process.

Tobacco and vape

Proof of age can support a statutory defense when the seller reasonably relies on it.

Missouri's tobacco statute uses its own proof-of-age rules, while federal law separately sets the minimum sales age at 21. For an operational workflow, the venue should account for both layers rather than relying on the older state-age wording alone.

Cannabis and hemp

Dispensaries check photo ID at every sale, and customer-record rules tighten on November 12, 2026.

Adult-use customers must present valid, unexpired government-issued photo ID and be verified as 21 or older. From November 12, 2026, a dispensary needs the consumer's written agreement to create or keep covered identifying records and cannot make that optional record a condition of service.
