Idaho ID scanning laws

Idaho does not restrict ID scanning, and its bars and lounges may not let customers under 21 inside.

For bars, restaurants and retailers, the practical questions are who may be inside a bar, when an ID check is required, which IDs count as proof of age and what information may be kept.

What Idaho venues should know

Do you have to check IDs in Idaho, and when?

It depends on what you sell.

Alcohol

Idaho prohibits selling or serving alcohol to anyone under 21, but it does not require every customer to be carded. Bars and lounges licensed to serve drinks on the premises also may not let anyone under 21 enter or stay inside, apart from staff 19 or older who sell or serve drinks and musicians and singers 18 or older, while they work. Restaurants, breweries, wineries and certain other places are exempt from that entry rule, and so are sports arenas, convention centers, live-performance theaters and fairgrounds while a lawful event is taking place.

When an ID presented to staff appears mutilated, altered or fraudulent, Idaho's alcohol rules require staff to contact law enforcement, refuse service or both. An ID that is found or voluntarily handed over must be delivered to Alcohol Beverage Control or law enforcement within 15 days.

Tobacco and vape

Idaho prohibits selling tobacco and vape products to anyone under 21 but does not require a check at every sale. If staff sell to someone under 21 without first asking for and examining a photo ID, that failure alone establishes the violation.

The exact wording

Any person who is eighteen (18) years of age or older who shall sell, give, or furnish, or cause to be sold, given, or furnished, alcohol beverage, including any distilled spirits, beer or wine, to a person under the age of twenty-one (21) years shall be guilty of a misdemeanor and upon conviction thereof may be punished by a fine of not less than five hundred dollars ($500) nor more than one thousand dollars ($1,000) per violation, or by imprisonment in the county jail for a period not to exceed one (1) year, or by both such fine and imprisonment.

No person under the age of twenty-one (21) years shall enter, remain in or loiter in or about any place, as herein defined, licensed for the sale of liquor by the drink at retail, or sale of beer for consumption on the premises; nor shall any licensee of either such place, or any person in charge thereof, or on duty while employed by the licensee therein, permit or allow any person under the age specified with respect thereto to remain in or loiter in or about such place.

If licensees or their employees receive identification documents which have been lost or voluntarily surrendered, they shall deliver the documents to an agent or investigator of the Alcohol Beverage Control Bureau or to other law enforcement officials within fifteen (15) days from the date they were received, found or voluntarily surrendered.

The failure of a seller to request and examine photographic identification from a person under twenty-one (21) years of age prior to the sale of a tobacco product or an electronic smoking device to such person shall be construed against the seller and form a conclusive basis for the seller's violation of this section.

Which IDs provide protection in Idaho?

Idaho uses the same proof-of-age list across alcohol, tobacco and vape.

Idaho's alcohol law names four kinds of ID, and the list is complete:

  • A driver's license with a photo and date of birth
  • An ID card with a photo and date of birth
  • A military ID card with a photo and date of birth
  • A valid passport

A license or ID card counts when it was validly issued by a state, district, territory, possession, province, national government or other equivalent government, so licenses from other states and other countries can qualify. Idaho State Police guidance also names tribal ID cards and foreign government-issued ID cards, provided they show the person's photo, name and date of birth.

The exact wording

No person licensed pursuant to title 23, Idaho Code, or his or its employed agents, servants or bartenders shall sell, deliver or give away, or cause or permit to be sold, delivered, or given away, or allowed to be consumed, any alcohol beverage, including any distilled spirits, beer or wine, to: (1) Any person under the age of twenty-one (21) years, proof of which shall be a validly issued state, district, territorial, possession, provincial, national or other equivalent government driver's license, identification card or military identification card bearing a photograph and date of birth, or a valid passport.

Any person who is nineteen (19) years of age or older may sell, serve, possess or dispense beer in the course of his employment, otherwise it shall be unlawful for any person to sell, serve or dispense beer to or by any person under twenty-one (21) years of age, proof of which, shall be a validly issued state, district, territorial, possession, provincial, national or other equivalent government driver's license, identification card or military identification card bearing a photograph and date of birth, or a valid passport.

(15) "Photographic identification" means state, district, territorial, possession, provincial, national or other equivalent government driver's license, identification card or military card, in all cases bearing a photograph and a date of birth, or a valid passport.

Any validly issued and unaltered state or federally issued identification is acceptable. This includes, but is not limited to, driver's licenses, tribal identification cards, passports, military identification cards, and foreign government-issued identification cards. An acceptable form must have the person's photo, name, and date of birth on the card.

Can you keep data from an ID scan in Idaho?

Yes. Idaho does not impose a general scan-specific retention period or field list.

Idaho's alcohol, tobacco and driver's license laws do not say which details from a scan may be kept or for how long. That leaves the retention period to venue policy.

Keg sales are different. The signed receipt for a keg sold for off-premises use carries the purchaser's name and address, and licensees must keep a copy for six months. What you choose to store can also bring Idaho's breach-notification law into play.

The exact wording

The receipt shall be on a form prescribed and supplied by the director of the Idaho state police and shall include the name and address of the purchaser and such other information as may be required by the director of the Idaho state police.

Licensees shall retain a copy of all completed keg receipts required by Section 23-1018, Idaho Code, for a period of six (6) months.

What other Idaho laws reach the data you keep?

Stored ID numbers can trigger Idaho's breach-notification law.

A customer's name kept together with an unencrypted driver's license or Idaho ID card number is personal information under that law. If a business discovers a breach of computer records holding that information, it must promptly investigate and, where the information has been or is likely to be misused, notify affected Idaho residents without unreasonable delay.

For most businesses the attorney general enforces the law, and intentionally failing to give notice can bring a fine of up to $25,000 per breach. Idaho does not currently have a comprehensive consumer privacy law or a biometric privacy law.

(5) "Personal information" means an Idaho resident's first name or first initial and last name in combination with any one (1) or more of the following data elements that relate to the resident, when either the name or the data elements are not encrypted:

Does scanning give you a defense if you serve a minor in Idaho?

Not for alcohol. For tobacco and vape, Idaho gives a retailer a defense when staff reasonably relied on a photo ID they asked for and examined.

Alcohol

Idaho's alcohol law does not give a venue a defense for checking or scanning an ID. Selling or serving alcohol to anyone under 21 is a misdemeanor, punishable by a fine of $500 to $1,000, up to a year in jail or both, and a later violation carries a fine of $1,000 to $2,000.

After a conviction, the court notifies the Idaho State Police director, who reviews the circumstances and may act against the license, including a suspension of up to six months, a fine or both. In that review, a scan record can help show what kind of ID the customer presented and what it showed at the time of sale.

Tobacco and vape

A retailer has a defense if staff asked for, examined and reasonably relied on a photo ID showing the customer was 21 or older before the sale. A scan record can help show which ID staff relied on.

The exact wording

Upon conviction of any person for a violation of the provisions of this section, the court shall notify the director of the Idaho state police. The director shall review the circumstances of the conviction, and if the dispensing took place at a licensed establishment or other retailer or distributor, the director may take administrative action he considers appropriate against the licensee or business including suspension of the license for not to exceed six (6) months, a fine, or both such suspension and fine.

It shall be an affirmative defense that the seller of a tobacco product or an electronic smoking device to a minor in violation of this section had requested, examined, and reasonably relied upon a photographic identification from such person establishing that the person is at least twenty-one (21) years of age prior to selling such person a tobacco product or an electronic smoking device.

For a violation of section 39-5705, Idaho Code, the permittee shall not be fined if the permittee can show that a training program was in place for the employee and that the permittee has a form signed by that employee on file stating that the employee understands the tobacco product or electronic smoking device laws dealing with minors and the unlawful purchase of tobacco products or electronic smoking devices, but the permittee shall be notified in writing of penalties to be levied for any further violations.

Can a customer refuse an ID scan in Idaho?

Idaho does not create a specific right to refuse a scan or require a manual alternative.

The state does not give customers a right to refuse a scan or require a venue to offer a manual alternative. How a venue handles a guest who does not want their ID scanned is therefore a matter of venue policy, subject to other applicable laws.

Idaho's public-accommodation law applies to those decisions. It prohibits denying service on the basis of race, color, religion, sex, national origin or disability.

Alcohol, tobacco and local rules

Bars and lounges

Bars and lounges may not let customers under 21 enter or stay inside.

The rule covers any room with a bar where liquor or beer is served for drinking on the premises. Staff 19 or older who sell or serve drinks, and musicians and singers 18 or older, may be there while they work. Each entrance must carry a sign saying that people under 21 are not admitted.

Restaurants and other venues

Customers under 21 may be inside, but may not be sold or served alcohol.

Idaho exempts restaurants, breweries, wineries and certain other places from the entry rule. Sports arenas, convention centers, live-performance theaters and fairgrounds are exempt while a lawful event is taking place. The ban on selling or serving alcohol to anyone under 21 still applies there.

Tobacco and vape

A retailer has a defense when staff asked for, examined and reasonably relied on a photo ID.

The ID must show the customer was 21 or older, and the check must come before the sale. Selling to someone under 21 without first asking for and examining a photo ID establishes the violation. A permit holder is also not fined for a second violation if it had a training program in place and a form signed by the employee on file.

Local licensing

Cities and counties can require their own alcohol licenses alongside the state license.

Cities and counties may license liquor by the drink alongside the state license. A city may adopt further regulations for those businesses, and a county may regulate licenses outside city limits, as long as the rules do not conflict with state law. A city may also require its own license before a business sells beer.

Tobacco is different. Local governments may not add rules on tobacco and vape sales beyond the state law.
